These Terms of Service govern your use of zymbrax.com and purchases from Zymbrax. By accessing the site or placing an order, you agree to these Terms and the policies referenced here.
Eligibility and Store Use
You must have the legal capacity to enter into a binding agreement in your jurisdiction. You may use the site only for lawful personal or business purchasing purposes. You may not interfere with site security, introduce malicious code, scrape or exploit the site without authorization, impersonate another person, submit false information, or use the site to violate any law or third-party right.
Products, Information, and Availability
We make reasonable efforts to describe and display products accurately. Colors and appearance may vary by screen, lighting, and production tolerances. Measurements are approximate unless stated otherwise. We may change products, prices, descriptions, quantities, or availability without prior notice. We do not warrant that all information is error-free, and we may correct errors before or after an order is submitted.
Orders and Contract Formation
Submitting an order is an offer to purchase. An order confirmation acknowledges receipt but does not necessarily constitute acceptance. We may accept, limit, or cancel an order for reasons including product unavailability, pricing or description errors, payment failure, suspected fraud, or shipping restrictions. A sales contract is formed when we accept the order and begin fulfillment or ship it, subject to applicable law.
Prices, Taxes, and Payment
Prices are displayed in U.S. dollars (USD) and exclude sales tax unless expressly stated otherwise. Applicable taxes are calculated at checkout. Payment is charged when the order is placed or confirmed through the selected payment method. Additional terms from the payment provider may apply.
Shipping, Returns, and Cancellations
Our Shipping Policy, Return & Refund Policy, and Order Cancellation Policy are incorporated into these Terms. Delivery estimates are not guarantees. Risk of loss and title transfer as provided by applicable law and the shipping arrangement.
Product Use
Use products only for their intended purpose and follow any included instructions and warnings. Customers are responsible for determining product suitability for their workspace and environment. Do not use a product in a way that creates a foreseeable safety risk.
Reviews and Other Submissions
If you submit a review, image, feedback, or other content, you represent that you have the right to submit it and that it is accurate, lawful, and does not infringe another person’s rights. You grant Zymbrax a nonexclusive, worldwide, royalty-free license to use, reproduce, edit for formatting or clarity, publish, and display the submission in connection with the store and its promotion. We may moderate or remove content, but are not required to do so.
Intellectual Property
The Zymbrax name, site design, text, graphics, logos, product content, and other site materials are owned by or licensed to GERMAIN ZYMBRAX LLC and are protected by applicable intellectual-property laws. No right is granted except the limited right to use the site for its intended purpose.
Disclaimers and Limitation of Liability
To the maximum extent permitted by law, the site and its content are provided on an “as available” basis. We disclaim warranties not expressly stated, including implied warranties, except where they cannot lawfully be excluded. To the maximum extent permitted by law, Zymbrax will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from site use or a purchase. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.
Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise. Before filing a claim, the parties will attempt in good faith to resolve the dispute by contacting one another. If the dispute is not resolved, it may be brought in a court of competent jurisdiction in Kentucky, subject to any non-waivable right to bring a claim elsewhere.
